ASA & LEADING 2A ORGANIZATIONS FILE LAWSUIT TO CHALLENGE NFA
On February 26, 2026, the American Suppressor Association Foundation (ASA Foundation), Buckeye Firearms Association, Jews for the Preservation of Firearms Ownership, and the Center for Human Liberty, announced the filing of a lawsuit challenging the constitutionality of the National Firearms Act of 1934 (NFA). The case, Roberts v. ATF, was filed in the U.S. District Court for the Eastern District of Kentucky. Local firearm dealer Meridian Ordnance LLC and two individuals are also named plaintiffs in the lawsuit.
The complaint argues that because the federal excise tax on suppressors and short-barreled firearms imposed by the NFA has now been eliminated, the NFA registration regime on these items can no longer be upheld as a legal exercise of Congress’s taxing power.
The lawsuit further maintains that mandatory registration of protected arms violates the Second Amendment. Under recent Supreme Court precedent, firearm regulations are constitutional only if they are consistent with the nation’s historical tradition of firearm regulation. The plaintiffs contend that no such historical tradition exists to support the NFA’s registry, rendering the law unconstitutional under the Court’s modern Second Amendment framework.
“The Second Amendment is supposed to be a guarantee – not a privilege subject to bureaucratic approval,” said Knox Williams, President of ASA Foundation. “However, for decades, the National Firearms Act has imposed burdensome and unconstitutional federal restrictions on law-abiding Americans. Now that the $200 NFA excise tax has been eliminated, the archaic NFA registration regime can no longer be justified. The ASA Foundation will continue to fight until this unconstitutional registration scheme is defeated once and for all.”

1. THE REGISTRATION AND TAX SCHEME OF THE NFA IS UNCONSTITUTIONAL
In 1937, the Supreme Court ruled that the NFA was primarily a revenue-generating measure and the registration requirements of the statute served to verify who had paid the required tax.
2. THE SECOND AMENDMENT PROTECTS YOUR RIGHT TO HAVE SUPPRESSORS
Suppressors have been classified as firearms since 1934. As such, they are bearable arms and must be afforded the same Constitutional protections by the Second Amendment as firearms.
3. ASA-F WILL FIGHT TO END THE REGISTRATION REQUIREMENTS OF THE NFA
Suppressors are modern day hearing protection devices that should not be subject to the unconstitutional tax and registration requirements of the National Firearms Act.
